General Terms and Conditions

1. Scope of Application

These General Terms and Conditions (“Terms”) apply to all contracts concluded between

DailyGerman — Moritz Ihlemann-Burkhart,

Materaweg 11/5, 79576 Weil am Rhein, Germany

(hereinafter referred to as “DailyGerman”, “we”, “us”)

and the users of the platform www.daily-german.com

(hereinafter referred to as “User”, “Customer”).

By using the website and the services offered, the Customer agrees to these Terms in their respective valid version.

2. Description of Services

DailyGerman provides a digital online learning platform based on the comprehensible input method. The services include in particular:

Access to learning videos

Livestreams (via YouTube, Vimeo)

The ability to submit questions, audio messages, and video messages via WhatsApp

Additional content (community features)

Display of learning progress (progress tracker)

Monthly subscriptions (digital content)

Support via email

All services are provided exclusively in digital form.

DailyGerman may update, expand, or modify the content, features, or structure of the platform at any time, provided that the essential contractual services are not materially impaired.

3. Registration and User Account

Access to paid content requires the creation of a user account.

During registration, the User must:

Provide a valid email address

Create a password

Provide accurate and complete information

The User is obliged to keep their access credentials confidential and to prevent misuse.

4. Conclusion of Contract

The contract is concluded when the User selects a paid subscription on the website, enters their payment details, and completes the checkout process.

DailyGerman will confirm the conclusion of the contract by email.

5. Prices and Payment Terms

All prices displayed on the website are final prices and include statutory value-added tax (VAT), where applicable.

Payments are processed via the external payment service provider Stripe.

The User authorizes Stripe and DailyGerman to automatically collect recurring payments as part of subscription agreements.

6. Subscriptions and Renewal

The platform offers subscriptions that can be canceled on a monthly basis.

The subscription is automatically renewed unless it is canceled no later than one (1) day before the renewal date.

Cancellation can be made at any time via the user account or by email to support@daily-german.com.

7. Digital Content & Right of Withdrawal

The User is granted immediate access to digital content.

During the ordering process, the User expressly agrees that the execution of digital content begins before the expiry of the statutory withdrawal period and confirms that they thereby waive their right of withdrawal pursuant to Section 356 (5) of the German Civil Code (BGB).

There is no trial period and no refunds, except in cases where refunds are legally mandatory.

8. Rights of Use

The User is granted a non-transferable right to use the platform content for private learning purposes only.

In particular, the following is prohibited:

Sharing or forwarding content

Sharing access credentials

Distribution or reproduction of videos

Commercial use

9. Submission of Questions, Voicemails and Video Content via WhatsApp

Users may submit questions, voicemails, and video messages for our videos.

By submitting such content, the User declares that:

they hold all necessary rights to the submitted material

DailyGerman may use this content during livestreams

the material may be publicly visible

the content may be used for marketing purposes (e.g. testimonials)

No remuneration is provided for such submissions.

10. Platform Availability

DailyGerman endeavors to ensure high technical availability of the platform.

However, temporary interruptions may occur due to maintenance, updates, or server-related outages.

There is no entitlement to uninterrupted availability.

11. Liability

DailyGerman shall be liable only in cases of intent and gross negligence.

In cases of slight negligence, liability shall apply only in the event of a breach of essential contractual obligations (cardinal obligations).

No liability is assumed for data loss, outages caused by third parties, or errors attributable to third-party service providers (including but not limited to Stripe, Hostinger, YouTube, Vimeo).

12. Data Protection

13. Final Provisions

German law shall apply.

The place of jurisdiction shall be Weil am Rhein, insofar as legally permissible.

Should individual provisions of these Terms be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Allgemeine Geschäftsbedingungen

1. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge, die zwischen

(im Folgenden: „DailyGerman“, „wir“, „uns“)

und den Nutzern der Plattform www.daily-german.com

(im Folgenden: „Nutzer“, „Kunde“)

geschlossen werden.

Durch die Nutzung der Website und der angebotenen Dienste akzeptiert der Kunde diese AGB in ihrer jeweils gültigen Fassung.

2. Leistungsbeschreibung

DailyGerman bietet eine digitale Online-Lernplattform an, die auf der Comprehensible-Input-Methode basiert. Zu den Leistungen gehören insbesondere:

Zugang zu Lernvideos

Livestreams (via YouTube, Vimeo)

Möglichkeit, Fragen, Audio- und Videonachrichten über WhatsApp einzureichen

zusätzliche Inhalte (Community-Elemente)

Anzeige des Lernfortschritts (Progress Tracker)

monatliche Abonnements (digitale Inhalte)

Support per E-Mail

Das Angebot erfolgt ausschließlich digital.

DailyGerman kann Inhalte, Funktionen oder Struktur der Plattform jederzeit aktualisieren, erweitern oder anpassen, solange dadurch die wesentlichen Vertragsleistungen nicht beeinträchtigt werden.

3. Registrierung und Nutzerkonto

Für die Nutzung kostenpflichtiger Inhalte ist ein Nutzerkonto erforderlich.

Bei der Registrierung muss der Nutzer:

eine gültige E-Mail-Adresse angeben

ein Passwort erstellen

richtige und vollständige Angaben machen

Der Nutzer ist verpflichtet, Zugangsdaten geheim zu halten und Missbrauch zu verhindern.

4. Vertragsschluss

Der Vertrag kommt zustande, wenn der Nutzer auf der Website ein kostenpflichtiges Abo auswählt, seine Zahlungsdaten eingibt und den Bestellvorgang abschließt.

DailyGerman bestätigt den Vertragsabschluss per E-Mail.

5. Preise und Zahlungsbedingungen

Alle Preise auf der Website sind Endpreise und verstehen sich inklusive gesetzlicher Umsatzsteuer.

Zahlungen erfolgen über den externen Zahlungsanbieter Stripe.

Der Nutzer ermächtigt Stripe und DailyGerman, wiederkehrende Zahlungen im Rahmen von Abonnements automatisch abzubuchen.

6. Abonnements und Verlängerung

Die Plattform bietet monatlich kündbare Abonnements an.

Das Abonnement verlängert sich automatisch, wenn es nicht spätestens 1 Tag vor Verlängerung gekündigt wird.

Die Kündigung kann jederzeit im Nutzerkonto oder per E-Mail an support@daily-german.com erfolgen.

7. Digitale Inhalte & Widerrufsrecht

Der Nutzer erhält sofortigen Zugriff auf digitale Inhalte.

Der Nutzer stimmt im Bestellprozess ausdrücklich zu, dass die Ausführung digitaler Inhalte vor Ablauf der Widerrufsfrist beginnt. Er bestätigt, dass er dadurch sein Widerrufsrecht verliert (§ 356 Abs. 5 BGB).

Es gibt keinen Testzeitraum und keine Erstattungen, außer in gesetzlich zwingenden Fällen.

8. Nutzungsrechte

Der Nutzer erhält ein nicht übertragbares Recht, die Inhalte der Plattform für private Lernzwecke zu nutzen.
